Attention:
On September 26, 2008, the Bankruptcy Court entered an order granting Delphi's motion to approve an Amended and Restated Global Settlement Agreement (the "Amended GSA") and Amended and Restated Restructuring Agreement (the "Amended MRA") with General Motors pursuant to which the Debtors will receive support from GM estimated to be valued at approximately $10.6 billion for its transformation (increased from approximately $6.0 billion in the January 2008 settlement). On September 23, 2008, the Bankruptcy Court entered an order granting Delphi's Hourly and Salaried Pension Program Modification Motion to freeze its hourly and salaried defined benefit pension plans and provide, as applicable, replacement cash balance or defined contribution pension benefits, a salaried retirement and equalization savings program, and a supplemental executive retirement plan. | | On October 8, 2005, and subsequently October 14, 2005, the Debtors filed a voluntary petition for relief under Chapter 11 of the United States Bankruptcy Code (the "Bankruptcy Code"). The forty-two Debtors are being jointly administered under Delphi Corporation, Case No. 05-44481. The Bankruptcy Cases are pending before the Honorable Robert D. Drain, Bankruptcy Judge, United States Bankruptcy Court for the Southern District of New York. | |
